Avystar – Terms & Conditions

Effective for all Distributors, Franchise Partners, and Sales Associates

These Terms & Conditions govern all commercial relationships, product orders, and sales transactions between Avystar and its distributors/partners/customers. By engaging in business with us, you agree to the following terms:

1. Product Supply & Dispatch

• All orders are subject to availability and confirmation.

• Products will be dispatched only upon confirmation of payment (unless agreed otherwise in writing).

• Delivery timelines may vary based on location and order size, but Avystar Pharma commits to prompt dispatch within standard timeframes.

2. Pricing & Payment

• Prices are subject to change without prior notice due to raw material cost changes, government regulations, or tax updates.

• Payment must be made via approved modes (Bank Transfer, UPI, Cheque, etc.).

• Any delay in payment beyond agreed terms may result in late fee charges or suspension of supply.

3. Order Cancellation & Returns

• Orders once processed and dispatched cannot be canceled.

• Return/replacement will be accepted only for goods with manufacturing defects, transit damage, or wrong supply—reported within 48 hours of delivery.

• Returned products must be unopened, undamaged, and in original packaging.

4. Marketing & Territory

• Distributors/franchisees are assigned non-exclusive rights unless otherwise agreed.

• Avystar Pharma reserves the right to operate or appoint other parties in the same territory unless exclusive rights are granted by a formal agreement.

5. Use of Brand & Materials

• The Avystar brand name, logo, product images, and marketing materials are protected and may not be used or reproduced without written permission.

• Authorized distributors may use provided materials for promotion within assigned territory only.

6. Regulatory Compliance

• Distributors must comply with all applicable Drug & Cosmetic Act, GST regulations, state licensing, and other legal requirements.

• Avystar Pharma is not responsible for misuse, misbranding, or unauthorized marketing by third parties.

7. Limitation of Liability

• Avystar Pharma is not liable for indirect, incidental, or consequential damages from use or supply delays.

• Our liability is limited to the replacement of faulty goods or refund of the purchase price.

8. Dispute Resolution

• Any disputes arising shall be resolved amicably. Failing which, the matter will be subject to the jurisdiction of courts located in Greater Noida, Uttar Pradesh.

9. Modifications

• Avystar Pharma reserves the right to amend or update these terms at any time without prior notice. Updated terms will be posted on the official website or communicated via email/WhatsApp.
